1. Acceptance of Terms

Welcome to SiteReady Weather Services. These Terms of Service ("Terms") govern your access to and use of our website (sitereadyweather.com), client portal applications, SMS dispatch alerts, PDF reports, and meteorological consulting services provided by SiteReady Weather Services, Southwest Florida Division ("SiteReady Weather Services," "Company," "we," "our," or "us").

By visiting our website, requesting a demo, enrolling in our 30-Day Pilot Program, or subscribing to our commercial monitoring services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Description of Meteorological & Advisory Services

SiteReady Weather Services provides specialized meteorological intelligence, operational decision briefs, hourly dry-in window timing, and real-time severe convective alerts tailored for commercial contractors (including roofing, concrete, civil excavation, painting, and grounds maintenance) operating in Southwest Florida.

Our deliverables include, but are not limited to: Next-Shift Decision Briefs (4:00 PM), Morning Shift Confirmations (5:30 AM), Real-Time Convective Change Alerts, 7-Day Commercial Outlooks, Historical Weather Verification Memos, and Client Portal Dashboard access.

3. Meteorological Limitations & Jobsite Safety Responsibility

Advisory Nature of Weather Intelligence & On-Site Authority

Atmospheric science and convective weather nowcasting involve inherent natural variability. While our forecasts and decision matrices are prepared with high professional meteorological rigor, all briefings, dry-in projections, and shift indicators are strictly advisory tools intended to assist contractor planning.

Contractor Responsibility: All final operational decisions—including whether to mobilize crews, commit batch concrete, open roofing decks, operate heavy cranes, excavate trenches, or evacuate personnel—remain solely and exclusively the operational responsibility of the contractor’s licensed project managers, superintendents, and safety directors.

Official Life-Safety Warnings: SiteReady Weather Services does not replace official emergency warnings issued by the National Weather Service (NWS), NOAA, FEMA, or local emergency management authorities. In the event of severe weather warnings (such as Tornado Warnings, Flash Flood Warnings, or Hurricane Evacuation Orders), contractors must comply with official public safety directives.

4. Client Portal Accounts & User Security

When registering for our Client Portal or assigning access to field personnel (foremen, estimators, superintendents), you agree to provide accurate and current contact details. You are responsible for maintaining the confidentiality of your portal credentials and for all activities that occur under your organization’s account.

5. Subscription Billing, Pilot Programs & Cancellations

30-Day Pilot Program ($149): The 30-Day Pilot provides 30 consecutive days of full monitoring, daily shift briefs, and SMS alerts for one commercial jobsite or route corridor. The pilot fee is a one-time charge billed upon onboarding.

Monthly Commercial Subscriptions: Standard subscription tiers (Essential, Operations, Multi-Site Corridor) are billed in advance on a monthly or seasonal recurring basis as defined in your Master Services Agreement or digital invoice.

Cancellation: Subscription plans may be cancelled prior to the next billing cycle upon written notice to our team. Invoiced services remain active through the end of the paid billing period.

6. Intellectual Property & License to Use Reports

All custom algorithms, forecasting models, portal software interfaces, branding, logos, and decision brief templates are the proprietary intellectual property of SiteReady Weather Services.

Subscribing clients are granted a non-exclusive, non-transferable license to view, download, print, and submit SiteReady Weather Verification Memos and Decision Briefs to property owners, general contractors, insurance carriers, and municipal inspectors for legitimate project documentation and delay verification purposes.

7. Limitation of Liability & Indemnification

To the maximum extent permitted by applicable Florida law, SiteReady Weather Services, its founder, employees, and meteorological consultants shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to lost profits, crew downtime payroll, material losses, liquidated damages, or project delays arising from weather events or reliance on advisory forecasts.

In no event shall our total aggregate liability arising out of or related to our services exceed the total subscription fees paid by you to SiteReady Weather Services in the three (3) months preceding the claim.

8. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Sarasota County or Manatee County, Florida.
